Internal regulations I) Preamble “Prize2consciences” is an independent training body registered under number 84420341242 with the prefect of the Auvergne-Rhône-Alpes region, located at 9 Place Saint-Charles, 42650 Saint-Jean-Bonnefonds. These internal regulations have vocation to specify certain provisions applying to all registrants and participants in the various courses organized by "prize2consciences" in order to allow the regular operation of the training courses offered. Here are some details relating to the terms used: - "prize2consciences" will be referred to below. after "training organization"; - the people following the course will be referred to hereinafter as "trainees"; - the training director of "Julien Contu" will be referred to hereinafter as "the head of the training organization" .II ) General provisions Article 1 In accordance with Articles L.6352-3 et seq. And R.6352-1 et seq. Of the French Labor Code, the purpose of these internal regulations is to e define the general and permanent rules and specify the health and safety regulations as well as the rules relating to discipline, in particular the penalties applicable to trainees and their rights in the event of a sanction. Everyone must comply with the terms of these regulations throughout the duration of the training action III) Scope Article 2: Persons concerned These regulations apply to all trainees registered for a session provided by the training organization for the entire duration of the training followed.Each trainee is considered to have accepted the terms of these internal regulations when he follows a training course provided by the training organization and accepts that measures be taken in his regard. In the event of non-observance of the latter Article 3: Place of training The training will take place in the premises of Julien Contu, or in the external premises. The provisions of these regulations are applicable not only within the premises of Julien Contu, but also in any premises intended to receive training. IV) Hygiene and safety Article 4: General rules The prevention of the risks of accidents and diseases is imperative and requires compliance by everyone with: - the applicable health and safety requirements at the training sites - any instructions imposed either by the management of the training organization or the trainer, particularly with regard to the use of equipment Each trainee must ensure his or her personal safety and that of others by respecting the general and specific safety and hygiene instructions in force at the training site. If he notices a malfunction in the safety system, he immediately informs the management of the training organization. Failure to comply with these instructions exposes the person to disciplinary sanctions.However, in accordance with article R.6352-1 of the Labor Code, when the training takes place in a company or an establishment that already has internal regulations. , the safety and hygiene measures applicable to trainees are those of the latter regulation.Article 5: Prohibition of smoking In application of decree n ° 92-478 of May 29, 1992 setting the conditions for the application of the ban on smoking in places assigned to collective use, it is forbidden to smoke in the training rooms, except in places reserved for this use. Article 6: Alcoholic beverages and drugs The introduction or consumption of drugs or alcoholic beverages in the premises is formally prohibited. It is forbidden for trainees to enter or stay in a state of intoxication or under the influence of drugs in the training organization. During breaks, trainees will have access to non-alcoholic beverage distribution stations. Article 7: Catering facilities The meal (s) are not covered by the training organization. Article 9: Fire instructions In accordance with articles R.4227-28 et seq. V) Discipline Article 10: Internship schedules The internship schedules are fixed by the training organization and brought to the attention of the trainees either by the invitation sent by electronic means or by mail. Trainees are required to adhere to these schedules. The training organization reserves the right, within the limits imposed by the provisions in force, to modify the internship schedules according to service requirements. The trainees must comply with the modifications made by the training organization to the organization of the training schedule.In case of absence or delay in the training course, it is preferable for the trainee to notify either the trainer or the manager of the training organization. In addition, an attendance sheet must be signed by the trainee. Except in exceptional circumstances, trainees may not be absent during traineeship hours. Article 11 - Absences, delays or early departures In the event of absence, delay or departure before the scheduled time, trainees must notify the organization of training and justify it. The training organization immediately informs the funder (employer, administration, Fongecif, Region, Pôle emploi,) of this event. Any event not justified by particular circumstances constitutes a fault punishable by disciplinary sanctions. In addition, in accordance with article R6341-45 of the Labor Code, the intern, whose remuneration is paid by the public authorities, is exposed to a deduction from his internship remuneration proportional to the duration of the absence. Article 12: Access to the training place Unless expressly authorized by the training organization, trainees having access to the training place to follow their training period may not: - enter or stay there for other purposes - facilitate the introduction of third parties to the organization - proceed, in these, to the sale of goods and services Article 13: Dress and behavior The trainees are invited to come to the training place in decent clothes and behave correctly with regard to of any person present in the organization, guaranteeing the respect of the elementary rules of good manners, of knowing how to be in community and the good progress of the trainings. Article 14: Use of the material Unless specific authorization of the management of the training organization, the use of training material is done on the training site and is exclusively reserved for the training activity.Each trainee has the obligation to keep in good condition the material entrusted to him in order to its formation. Trainees are required to use the equipment in accordance with its purpose. The use of the equipment for other purposes, particularly personal ones, is prohibited, except for the equipment made available for this purpose. The trainee is required to keep in good condition the equipment entrusted to him for training. He must make use of it in accordance with his purpose and according to the rules issued by the trainer. The trainee immediately reports any material anomaly to the trainer. At the end of the traineeship, the trainee is required to return any material and document in his possession belonging to the training organization, except teaching documents distributed during training. : Recordings It is strictly forbidden, unless expressly waived, to record or film training sessions. Article 16: Educational documentation Educational documentation provided during training sessions is protected by copyright and may not be reused other than for strictly personal use Article 17: Formalism attached to the training follow-up The trainee is required to fill in the attendance sheet as the action unfolds. He may be asked to carry out an assessment of the training At the end of the training action, he is given a certificate of end of training and a certificate of attendance at the training course to be sent, as the case may be, to his employer / administration or the organization funding the action. The trainee submits, as soon as possible, to the training organization the documents he must fill in as a service provider (request for remuneration or payment of costs related to training; registration or entry certificates internship…). Article 18: Responsibility of the organization in the event of theft or damage to the personal property of trainees The training organization declines all responsibility in the event of loss, theft or damage to personal items of any kind left by trainees in the training premises Article 19: Disciplinary sanctions Any failure by the trainee to one of the provisions of these internal regulations may be subject to a sanction pronounced by the head of the training organization or his representative. Any action considered to be faulty may, in depending on its nature and severity, be subject to one of the following sanctions: - call to order - written warning by the director of the training organization or his representative - reprimand - temporary exclusion from training - definitive exclusion from training Fines or other financial penalties are prohibited. The head of the training organization or his representative informs of the sanction taken: - the employer of the trainee employee or the administration of the trainee agent (Editor's note: only when the training is carried out on order of the employer or the administration) - and / or the funding of the internship The exclusion of the intern may in no case give rise to the reimbursement of the sums paid for the training Article 20: Disciplinary procedure a) information of the intern No sanction may be imposed on a trainee without that the latter has been informed in advance of the complaints against him. However, when an act, considered to be wrongful, has made essential a provisional measure of temporary exclusion with immediate effect, no final sanction relating to this act can be taken without the trainee having first been informed of the grievances against him and possibly, that the procedure described below has been respected: b) summons for a n interview When the director of the training organization or his representative plans to take a sanction, the following procedure is carried out: - he summons the trainee, by registered letter with request for acknowledgment of receipt or delivered to the person concerned against discharge, indicating the subject of the convocation - the convocation also indicates the date, time and place of the interview as well as the possibility of being assisted by a person of his choice trainee or employee of the organization training c) possible assistance during the interview During the interview, the trainee may be assisted by a person of his choice, in particular the internship representative. The director or his representative indicates the reason for the envisaged sanction and collects the intern's explanations. D) pronouncement of the sanction The sanction cannot intervene less than one clear day or more than fifteen days after the interview. The sanction is the subject of a written and motivated notification to the trainee in the form of a registered letter or delivered against discharge.VI) Representation of trainees Article 21: Representation of trainees For collective training actions whose total duration exceeds 500 hours, the election of a titular delegate and a substitute delegate by single-member ballot in two rounds is carried out simultaneously, according to the following procedures: - all the trainees are voters and eligible. The ballot takes place, during training hours, at the earliest twenty hours and at the latest forty hours after the start of the course. - the head of the training organization is responsible for organizing the ballot. ensures the smooth running. He sends a deficiency report, sent to the regionally competent regional prefect, when the representation of the trainees cannot be ensured. - the delegates are elected for the duration of the training course. Their functions come to an end when they cease, for any reason whatsoever, to participate in the course. If the titular delegate and the substitute delegate ceased their functions before the end of the internship, a new election shall be made. Article 22: Role of the intern delegates The delegates make any suggestion to improve the course of the internships and the living conditions of the interns. trainees in the training organization.
